Did you have a personal experience about pre-existing conditions getting covered? Or do you personally know anyone who got covered for pre-existing conditions? If so, please provide complete details. How much was the total expense? How much did they cover? Was there network negotiated charge? How much time did it talk to get the money back?

I understand DREAM act is not related to EB issues. What I meant was, just like how DREAM act is being added to an unrelated bill, we should work on adding things like 'unlimited STEM visas' and 'recapture unused numbers' to other bills and get them passed.

Can someone reserach and find out where exactly he has stated that. You cannot do that till you have proof. If you know the aprox date he said that i can look up his trascripts.

Although my lawyer confirmed that one can still have a valid H1B status after travelling using AP. My co-worder is still in doubt. Our corporate attorney seems to be clueless for this tricky situation.

But, if some officer may feels that, to seek the transfer cum extension one should be in same status. It is hard to convince them in case of RFE, as there is no specific memo/policy/regulation for this situation. It also fuels the natural doubt of the officer?. Why the AOS applicant entered on AP seek non-employment chage of status (instead of using EAD)? Using EAD and AP is simple and avoids complications in employment transfer. This is my view.

Hello,
I am new to IV and am just starting to read some of the blogs. I figured I could use some advice from you all since I'm at a point of giving up hopes. I am on H-1B visa through my employment at a university (as a Professional Research Assistant), but working at a non-profit organization (NPO) who funds a research project between the two entities. My H visa is reaching its max of 6 years in Jul 2008. The NPO would like to keep me beyond that and I've told them about the PR petition. THe problem is my position will be based on funding availability, in which they could guarantee employment until Mar 2008, and are working towards raising more funding beyond that period. Is the NPO still able to file a PR petition for me? What about the "ability to pay" which they use to hold back on pursuing the petition?

EB3 I is going to have a long wait. I had applied for Canadian green card and had received it. At present i have EAD and AP. Is it worthwhile to go into consular processing and work in canada or apply for a blue card or think about Australia. If this sounds okay how should i proceed.

Yes, there are sub-limits in ICICI for persons above the age of 55 years. Please look at the policy wording, a 16 page document. Look at Page 3 in a section called 'Special Conditions'. It is mentioned there.

Couldn't disagree more with kaisersose or guns. GC system as it exists is rubbish and ugly in many ways- but as bad as it is that's what's legal and in place now so we have to go thru that and if possible, make it better along the way appealing to the saner elements of the society. Brain drain is tricky - you guys are honest enough to admit to not having it so theres clearly no drain there but other programmers will disagree. Some history lesson's also in order - will do it later. I received a sms saying that my case status has been updated (weird they sent it @ 9:25 pm PT). I was like here comes another biometrics appointment... but still let's check the status online. To my surprise and by god's grace, case status was changed to "Card/Document Production" (still cannot believe it). I dunno what triggered this but i did contact my Congressman yesterday. My wife's status has also changed to "decision" - should move to "Card production" soon.
My suggestion to all of you - please don't lose patience and do whatever you can from your end to expedite your case. It's your GC and you've to make sure you get it. Contact I/O, infopass and congressman/senator. Don't expect anything from your lawyers as they only care about money and it is in their best interest to see your case pending (more RFEs, EADs, APs, etc).
Thanks and all the best to all of you out there still waiting for your GC.

Hopefully someone from all the complainants in this forum will spearhead this initiative and hopefully there will be people out there that will stand up for themselves and join this pool
If IV can outline how it is going to help, that would really make many people come out of the shelves. However, though we talk so much, people are still scared to identify themselves against the employer. However, they may be ready to outline everything against the specific employer as an anonymous person. we got to deal with a situation where people are ready but anonymously. How can we handle this.
