How can people write this kind of information. Even I have come through and Indian company and I used to pay all taxes here which includes, Federal, Social, State etc.,
This should end. People here should know that we are paying all taxes. And we are paying Social Security tax as well. Because of retrogression we don't yet know if we would get our green card. We still pay for it and we don't take a dime of it if we have to go back to India.
We are helping the elders to have regular pay and this is what we hear? If there is a way as our friend said we should confront this legally.

Your PD is 05/2003... I confidently bet you would not be in a queue for the guys who will go back.:D:D:D. By 4th July 2008 mostly you will be done with this wait hell.. Even if somebody who will be going back wants to track you , you would not be trackable on 4th July 2008.:mad::mad::mad::mad: So please keep patience and help others to maintain the same at least.

well, I have to keep my hopes up. Since I HAVE to wait to get H4 extension before I can apply for H1 transfer, I'd like to see them last long enough so that I can get an H1 IN time, this year.
It can be so disappointing to get the job but miss the quota for 2 consecutive years :mad: :mad: :mad: and then 2 years I was ineligible for H1 because of the 6 yr limit. :( :mad:
Anyway, every dog has its day and I am hoping this is the year when I get my H1. :D

You have to see my quote from the context of immigration. I never said illegal immigrants do not have any rights. Human rights are across the board. Every nation must follow these standards. Illegal immigrants can not sneak into a country and then demand that they should be given citizenship.
Regarding undocumented workers filing with EEOC, please quote me few cases like that. I doubt if it is ever possible. In my personal opinion, when such workers are subject to deportation when found, where is the foundation in that case? Are you suggesting that non-citizens can apply for jobs in defence and aviation and complain to EEOC if rejected?
Again this could be looked at from many angles. The right to march and demand citizenship is protected under the 1st ammendment. Whether they get the citizenship or not is another issue but indeed yes, as ridiculous as it is, one is free to have the audacity to make statements that may be ridiculous in nature and that is their right under the 1st ammendment to do so as long as they are within the borders of the US. It is these types of freedoms that distinguish America from many other countries, to the extent to where even a person subject to deportation has the right to due process. The 1st ammendment guarantees the freedom of expression. Freedom of expression further covers the right to free speech, press, assembly and to petition the government for a redress of grievances (which is what the undocumented are doing in any case) etc [more here (http://www.law.cornell.edu/wex/index.php/First_amendment)]
Indeed a Federal District court has already ruled that immigration status is not a matter that is debatable in a EEOC/discrimination law suit. If the below is not sufficient there are some actual cases involving undocumented workers who were not victims of human trafficking.

"We are pleased with the court's order because Title VII's protections against discrimination apply to all employees whether they are documented or undocumented," Burnside said. If you read my other post correctly, it said the exemption was with security clearance related jobs. The two types of jobs you cited more than likely require security clearance but if they do not then its fair game for a discrimination complaint. Security clearance is only available to US citizens. My point is that if an employer with more than 4 employees whose job offering does not require security clearance or does not touch on matters of national security has a job posting claiming 'US Citizens Only' and an eligible for work non US citizen eg Green Card Holder or H1-B, EAD holder applies and is rejected primarily on the basis of their national origin or immigration status then yes, they do have credible grounds upon which to file an EEOC complaint. Note that an employer is only supposed to ask for documents that identify eligibility to work when they have made the decision to hire and are filing out form I-9. For instance there is already a case where EEOC or the DOJ won a case because an employer insisted on seeing an employee's GC and would not take an EAD. I am not in the IT industry so I have no idea about these Desi companies till today. If they sell EB2 LC for 20k USD, how come there are still so many people waiting instead of buying a GC?

Could we keep calling, even after raising one SR?
Raised an SR on 08/25/2009. Took infopass on 09/02/2009 and came to know that mine, spose and the kid got pre-approved.
Recd a response for my SR on 09/04/2009 from uscis saying that my case is being actively processed. Called uscis again on 09/04/2009 and got good scoldings from the 2nd level CSR saying in a rude and harsh tone, that I have already raised an SR and am supposed to wait atleast for 60 days before calling again.
Could I still persevere and call uscis? I was never so anxiuos or dissappointed before at not getting email.
Actually, I thought what the heck and tried it from my personal email. And they responded in 2 days. The response was all BS...full of grammatical and factual errors with strange sentence constructions...seemed to have been texted by a highschooler.
What actually worked was POJ method of reaching NSC IO.
9/3/09: IO was curt, but I insisted on assigning my case to an IO.
9/4/09: IO was all sweet and honey...told me that my case had already been assigned to an IO because of my call the previous day. (This is important, folks - getting your case assigned to an IO). She was so approachable, I asked her if she could approve my case now. She obviously said no, but said she would see what she could do. This was the best response from NSC so far. Asked me to wait for one more day. It was long weekend, so had to wait 3 looooong days.
9/8/09: IO gave the approval news. 5 minutes later, my wife called and got a really annoying IO, who instead of looking up her case, went on a tirade. That night got the email.
9/14/09: Got the card.
I did try 2 Senator's office, a really hopeless CongressWoman, both Obamas, both Bidens, Napolitano, Mayorkas, Pelosi, Ombudsman, two NCSC SRs, AILA (through my attorney). And nothing worked. It was funny that the Senator's office called me to wait 60 more days. When I told her of my approval, she was short with me. So, in my case, nothing worked except the POJ method and personal perseverance. Keep on calling until you find a good IO to help you. Good luck!
