You raise a very valid point.It is not as if these consulting companies are subsidised by the US govt to provide welfare to poorly qualified aliens - these companies are surviving and thriving in a free economy.This tells me that either (a) these consulting companies do a good job for their customers, despite the "cooks", "maids" and "servants" posing as software engineers or (b) There is a large enough demand for these skills that the clients cannot find enough qualified locals to hire on a full-time basis; hence go in for these "body shops".

Was the Department of State's unprecedented action on July 2, 2007, issuing an "Update on July Visa Availability" closing off visa availability for the rest of the fiscal year for employment based cases and essentially gutting its July visa bulletin (which opened the employment based categories EB-1 through EB-3 for adjustment of status applications) all about the money with U.S.C.I.S. in the role of culprit? We believe the answer unfortunately is "yes" and reflects U.S.C.I.S.'s desperate desire to grab its huge future fee increase from individuals that it saw slipping through its fingers. U.S.C.I.S. undoubtedly perceived its expected windfall of hundreds of millions of dollars through its outlandish July 30th increase in fees for petitions and applications (average increase 66%) threatened by the July visa chart which would allow many employment based individuals and their families to beat the fee increases. A typical family of four (husband, wife, child aged 16 and the other 12) applying for adjustment of status currently pays $1,605 to U.S.C.I.S. (including I-140 charge). That same family on and after July 30th would pay $4,105, an increase of $2,500, or 255%. If one multiplies those figures by at least 100,000 ( $250 million difference),[1] one can imagine the explosive temper of top U.S.C.I.S. officials when they saw the Visa Office July chart. U.S.C.I.S. has made no bones that it is depending upon the fee increases to fund its proposed systems and structures for the 21st century.
The Visa Office made it clear through the updating of the visa bulletin that its update was only because of U.S.C.I.S. action using the phrases "The sudden backlog reduction efforts by Citizenship and Immigration Services Offices during the past month....", and "As a result of this unexpected action....." The Visa Office cited these efforts as resulting in the use of almost 60,000 employment numbers. It is also clear that the Visa Office had no wish to defend U.S.C.I.S. when it issued its update on July 2nd. Whether it retains its stance in the future of washing its hands and pointing the finger at U.S.C.I.S. remains to be seen in light of probable Administration pressure to spin the story in a more positive light to the government as this Administration has exhibited a continual attitude of "soaking" immigrants, legal or otherwise ( $25,000+ for a family of four to immigrate under the recent fallen Senate bill ( See our article, "$10,000 Required For Earned Legalization and Adjustment Under the Secure Borders, Employment Opportunity and Immigration Reform Act", http://www.alanleelaw.com/english/articles/a2007-05-26.htm), which figure was modified from the earlier Administration proposal of $82,000+ ( See our article, "Mr. Lee's Comment to March 28, 2007 White House Immigration Reform Proposal - Z Visas", http://www.ilw.com/immigdaily/digest/2007,0403.shtm in "LETTERS" section), the passed amendment to S. 1639 raising H-1B surcharge fees to $5,000 on top of the fraud ($500) and filing ($190) fees, and the rapacious July 30th U.S.C.I.S. fee increase). (The exact differential was 115,000 cases, a rate of about 16,400 per month). The author has no knowledge of the exact number of cases that U.S.C.I.S. claimed to close in June for the State Department to announce that almost 60,000 employment numbers were used (employment based immigrant visa numbers are also requested by U.S. consulates and embassies), but notes that the vast majority of employment based cases are with aliens in the States who adjust status here rather than consular processing their cases. If U.S.C.I.S. claimed to clear anywhere in the area of 40,000-50,000 cases last month, that number for one month is difficult if not incredulous to believe, and if true would have involved massive shifts of U.S.C.I.S. personnel from other responsibilities to comb through and adjudicate all files of persons eligible to immigrate through employment, or less than careful consideration of the cases. Hopefully the agency was not in such a desperate state as to cut corners to endanger our national security if it was the latter case.
The facts and the legality of U.S.C.I.S.'s actions will undoubtedly be the subject of multiple lawsuits. However this turns out, the agency and the Administration will wind up with less respect than before. This Administration needs all the good publicity that it can muster in light of its unpopular Iraq war and recent actions freeing Scooter Libby (not even Paris Hilton avoided imprisonment) and supporting Attorney General Alberto Gonzales and creating further public mistrust of the justice system even after confirmation that he and other White House aides politicized the selection of United States Attorneys. Unless U.S.C.I.S. and the Visa Office can change course, this episode will unfortunately become a black eye to all parties as further facts emerge in the coming days.

H1-B has the following advantages under certain conditions.
1) If you are not yet married, you dump H1 and you are dumping the ability to bring your future wife to US immediately after marriage.

same thing happened with my wife's case too, RFE status change on 4/3 and then again a soft lud on 4/6 on my wife and soft lud on mine on 4/7 ... no status change... can you guys let me know once you receive the hard copy... i will update once i receive it...so far havent received and waiting for it...as we have only 30 days to respond...
We received the RFE for the Td vaccine that was missed somehow by Concentra. But since she is nursing now, we were able to get a blanket Waiver for her.

I just thought I will play the devil's advocate.
It could be that $100 or $50 is a big amount for people. Maybe people do not make $80K a year, just half of that (there are may H1Bs like that). Micro-payments may be a better option for some people. Do we want to disallow those contributions as well? People who want to pay will pay and people who do not want to pay will not pay. I guess we just have to make sure that we donot deny the people who want to pay but cannot. :)
I am willing to go along with monthly payments as there seems to be a consensus on this forum that it is the best option.

This has been discussed umpteen number of times, but I am going to share a personal experience here (shared once already on a similar thread).
For the last state chapter (Diwali Mela) event in North CA we were accepting ANY AMOUNT for a contribution, but were suggesting $25 or $50.
How many contributed? About 20 from a state chapter that boasts of 150+ members.
The fact is, people do one of the following:
1. look at the recommended amount and contribute that amount (most of our donors were $25, and a few paid $50)
2. pay a high $ amount simply because (s)he is convinced he wants to help as much as possible! (Most of the volunteers for the event paid $50 or more, and three of them paid $90/$100 each)
3. DO NOT pay, no matter what, as they are not convinced it will help reduce their waiting time
One more time... IV is not turning anyone away. If you can only contribute $10 a month, please feel free to paypal it yourself to donations at immigrationvoice.org
Like the squirrel who helped Lord Rama construct the bridge (sorry for making this a slightly "Indian" post, but can't think of a better analogy) every small bit is going to help IV, and will be most appreciated!
However, the bridge to the GC is a long one, and our Lord Rama (IV) needs thousands of hard-working and contributing monkeys to make it a reality:D

This is not a waste of time. CNN really cares about rating and I am pretty sure for many people like you and me, CNN is the first stop for news. If they realize that we are a force to reckon with, they will think twice before airing such shows. By signing nobody is expecting, CNN firing Lou Dobb's but at least CNN will be careful airing these baseless facts..That's all we need..attention and fairness..espeacilly when they claim they are the most trusted name in the news..

Just with few members going against you within couple of hours, you are backing from your point. Then imagine how tough it will be to work for our goals working against our forces on daily basis in this country.

We had similar problem in 2004 .Actual mess was created by VFS .Check your online status,I think you can use your passport number to track your passport. In our case passport was transfer to different vfs office .after three days they return our passport to Mumbai consulate ,this hole process took us more than week to get passport in our hand.Dont get panic...

We do see such threads on the forum occasionally where the employee is being cheated/asked to sign a contract/is not being paid on bench/employer is threatening etc etc... There are several instances where members have posted negative comments about consulting companies and how employees are unhappy working for them.

I want to understand the reasons why people are not filing lawsuits against such companies yet? Why are we not reporting them to DOL and USCIS? Especially after filing I485 and expiry of 6 months, people are in a better position to file lawsuits against such employers.

It is very difficult to get a bill passed in House for increasing visa numbers. Be it legal or illegal there is no way House will pass anything that increases visa numbers this election year. I am doubtful even for next year.
For this year or for now we should just get something like "ability to file 485 even when visa numbers are unavailable". This is something which will provide some relief to all of us and has good chance of going through. Subsequently we can keep trying to get the SKIL bill passed next year.
Absolutely. Now with PERM and premium 140, if we can file 485, and then hit the snooze button for 10 years -- no problem for me. I know, not everyone will be lucky to board onto the PERM, but atleast it will be relief for most of us.
For this year or for now we should just get something like "ability to file 485 even when visa numbers are unavailable". This is something which will provide some relief to all of us and has good chance of going through. Subsequently we can keep trying to get the SKIL bill passed next year.
Absolutely. Now with PERM and premium 140, if we can file 485, and then hit the snooze button for 10 years -- no problem for me. I know, not everyone will be lucky to board onto the PERM, but atleast it will be relief for most of us.

Secondly, I also dont agree to the online degree comment as well. My collegue just finish his Masters from North Carolina University and I can say it was not easy...

here are my 2 cents..
its nice to talk endlessly about what went wrong and bitch about it till the morning. one thing we all need to realise is this : we are going to have failures. period. just like we have had failures in the past. this is not going to be easy where you win every single legislation. 10% hit rate is success enough given the opposition and difficulties we face. so now, given that our batting average is going to be low, the question is this : everytime we have a failure, if people are going to sit on their butt, smoking their pipe dreams and doing monday morning quarterbacking about what part was wrong, then shouldn't they also volunteer to their local IV section to make it better? lets face it, if you really think something can be done better, then volunteer to the local IV branch and do it. everybody can benefit. but if all you are going to be doing is sitting here and posting negative messages, then you hurt everybody, starting with you. the opposition is much better organized, has more money and has great influences on the political inside. if you are not providing any constructive or organizational help, causing people to be distracted and causing IV core to lose their focus, and if you are not willing to volunteer to make it better, then in my opinion its best to step aside, be quiet and let the people in charge do it. again, if you are not helping, then you hurt everybody starting with you.
in this case, like paskal mentioned, if you think the phone calls were not important, then you haven't seen the victory message from numbersusa where they talked about the deluge of phone calls that were made by their supporters and how crucial it was in throwing out the visa recapture amendment. if anything, perhaps we could have gotten better organized with the calls. But I suspect things also moved much faster than anyone anticipated, including IV core.
lets focus our energies and support IV core and ourselves.

I am 2007 PD EB3. I know i am screwed :-) , but our discussing out unfortunate luck here , wont change it.
I am not even dreaming about my GC. I am just enjoying my life today, as i have no control over tomorrow. The irony , i was qulaified for EB2, but my lawyer didnt want to do an extra work(BS + 7 Years) , so he put me in EB3.
Let EB2 get there GC's first , and may be the illegals also get it before EB3, I really dont know the point of discussion of this thread.
