Congress is putting so much of restrictions on H1B and reducing Green Card for employment based.
I think this is the time to negotiate with Businesses and try to release a joint statement that
"Business will transfer the jobs to India/China along with people who are currently on H1B and struck in Green Card backlog. This may force business to close some divisions in the US and eventually US citizens will loose job."

This may be a rudimentary question, before I ask this Q to my attorney, I wanted to get some information from the public who are in the same boat as I am...
My PD is Dec 2005. I have 2 more years of valid H1B visa time.
Lets assume that I apply for my 485 in a month or two and that I get my EAD by november. I hunt for my "right" partner and get married after november and I plan to get bring her to US of A... here are my Q's
1) Is my H1 going to be valid after I get my EAD approved?
2) Do I "have" to use my EAD card and discard my H1 at all? Can I travel back and forth to India on my H1 even after I have my EAD?
3) Suppose that I bring my wife on a valid H4 through my H1 (even though I have my EAD - I am assuming that for question #1 & #2, the answer is 'YES')
I can file her I485 as long as the dates are current (or current to my PD atleast). Now, in a case if the dates are not current, I can still have my H1 in a valid state so that my wife's status is not in jeopardy.... How about the following:
Some IO was just playing around at MySQL database prompt. Just browsing without modifying any data... but it was recorded as LUD.
They were training new IO's and showing them some old applications as examples. And it registered as fresh LUD's.
They were performing data-mining/archiving on some old apps...I say, unless and until you receive a letter from them, just chill and get back to worrying about retrogression :-)

I disagree. It all depends on attitude. IV is an organization "for the members", "By the members". If your attitude is "I will get on IV JUST because I WANT something" and "If I got it, I don't care" and "If I have questions during naturalization stage, I will get back on IV" may not mean that you have a great life or enjoy life after GC. Life after GC is not that rosy as you think. Big companies - hiring is the same for GC/h1b so u will not have preference. If you are independent and want to do something on ur own - it is not easy either - it is more stressful and challenging - this is life my friend, 95% of startups fail and these people are seen nowhere after that. Very few people are successful and that too with a lot of difficulties, hard work and faith. The "enjoy life" after GC is generally not U but your next generation (children) will bear the fruits. they will enjoy all the freedom and comforts until reality hits them in form of career and family life - this is something everyone faces.
A lot of people love to be on IV - say, if someone has answered someone's question on IV and the person is benefitted - thie person is extremely happy for the other person.

If H1B employees are being mistreated by a certain class of employers, then what does that have to do with shortage of visa numbers?

The H1B program does provide ammunition to anti-immigrants to use that paint-brush and paint the entire program of H1B and Employment based GC as bad. Fortune 500 companies dont engage in unethical behavior. The TCS, Wipro etc maybe do that. Small bodyshops certainly do that. I am yet to see a small body-shop, operated by a citizen of foriegn origin, working by the book and treating employees well.
But all said and done, these things make our life more difficult and exacerbate the situation that arose from retrogression. However, these things didnt cause retrogression.
At the most, these issues of H1B abuse may have provided support to some groups in keeping the H1B quota down. However, it has nothing to do with EB quota. In fact, IEEE-USA advocates bringing down H1B quota and RAISING the employment based GC quota, in order to remove factors that encourage employer abuse.

My company got an RFE for ability to pay from USCIS. we are responding back with my companies 2006 tax returns and w-2 which shows more than proffered wage determined by Dept of Labor during PERM. I hope this should be fine and I will get a favorable response.
My concern is whether I should apply for 485 or should I wait till 140 approval to apply for 485.

Just did a rough sketch on paper, and then drew it up in vector, no secret really... and to be honest it isnt perfect at all, but turned out ok.
I guess drawing it at a larger scale then shrinking helped with some of the fine tuning.

I am with the same employer who sponsored GC. Until GC was approved I was with H1B visa. Is it neccessary for me to file I-9 after GC?

Sorry I missed your question before. My take on your situation is that you are good, and do not worry too much about USCIS's way of doing things. Did your company serve you any temporary suspension/reinstatement notice(s) coinciding with these payroll gaps? If not, and I would guess not (because that would reflect poorly on the company's health), your story means that as per your original employment letter, you have been with your employer continuously for 9 months after GC, and presumably longer (you did not say about any plan of leaving them soon), even though you are not being paid regularly. If anything, such payroll discontinuity should help establish your intention of remaining with your employer despite the hardship, if this issue comes up during citizenship interview. On your part, you should keep a detailed log of the dates you missed payments, in addition to all relevant papers (this goes back to DO item #3 in my list).

I entered the country in Jan 08 using the AP while I was still working for my GC sponsoring employer. Then in June 08 I joined another employer by transferring my H1B to the new employer. I did have the option of using EAD but I wasn't sure if the renewal will come before the expiry of current EAD. So decided to transfer H1 and my new employer graciously agreed to it.
We did a premium transfer so got the approval in 2 weeks. Money does wonders (Almost like the proverbial paper weight with files). I confirm that the I94# number on I797 approval notice is same as the I94# number I got when entering the country in Jan 08.
So this should be a good news for folks who are trying to do the same. I am in a different boat right now. I have to travel to India this November. I plan to return using AP. But now my employer is different from my GC sponsoring employer. Another issue is that I am going only for two weeks while my wife will be in India till Mid Jan. So we will enter US separately using AP. Please share your thoughts if you have been in this situation.

Please refrain from fighting on EB3 and EB2 issue. We all know how difficult retrogression has been to every one here. As some one has already said, If interfiling was so easy and every one was fortunate enough to file another Labor/140, EB-2 would have been in 2002 or along with EB-3. AFAIK, Interfiling is some thing the law allows and as long as one does what the system allows and is not gaming the system, its perfectly fine. Don't rub salt on others wounds. Do what you can to improve the system. IMO, the backward movement was a knee jerk reaction to the false demand, shown by USCIS with a huge movement in PD. As you may know, this is purely demand and supply based DOS will move dates forward as soon as they realize that there is not much demand. DOS keeps track of all visa number requests and approvals based on PD's. The problem is DOS just does not know how many applications are pending per country per category to stop the back and forth movement of dates and make the date movement strictly forward. DOS clearly made this a requirement in OCT 08 bulletin and lets see what happens in the next few months. 2nd Q will be key as the over flow will start to trickle based on demand in EB-1+EB-4+EB-5
