Hey guys, thanks for the replies and the good advice, which helps a lot. It's true that prevailing wage for H1b and CG are different, so I don't think my employer is breaking the law...at least not yet. (Logiclife, what do you think? Wouldn't the attorney had told them that they are breaking the law?) It's just a hard reality check to realize that all the "we care about our employees" is just a smoke screen.

It was a ridiculous mail by chanakya..If we keep accepting the system as is then there will be no change. we have to make efforts to change the system, clean the system or make it better. And to everybody else, yes the system is defined to bring in cheap labor and exploit them as much as possible. Otherwise it would be ridiculos in the 21st century to be worrying about immigration. Can you imagine when billions of dollars can cross boundaries within seconds without any rules, destroying lives for many, creating new for few..If we can allow capital to do that, why should labor be restricted? and then why do we call it free market?
So yes..we need to complain and crib and work for better things..not accept status qo and stay put.

May be that is the reason you took offense when people commented on Bcom thing. An MBA is valuable only if your bachelors degree is valuable. Many people have this wrong notion that it does not matter what you have in your bachelors, if you get an MBA everything is all set. Companies need engineer + MBA combination. Very few companies hire MBAs for accounting work. DOn't confuse accounting with finance, they are different. I can tell you that for sure, as i work in finance.

I assume you've likely never studied in India though. An bachelor's degree in engineering is not very expensive, if you have good grades.
10 years back it would cost about $100-200 a year, if you qualified through a state ranking system.
Tony, I didn't grow up in India. I am oblivious to its education ways. That said, some of the comments expressed here, is not the way to talk to anyone with an education, no matter what school they graduated. Anyway, I'm done here.

Outsourcing cannot be stopped with these nonsense bills . Outsourcing can only be stopped when the US market relizes that it is highly overpriced for the same job that is doine abroad for a far lesser price and adjusts accordingly . Every work has a value associated to it and the price needs to be paid according to the value of the work and not the place it is done ( India or the US )

GM staff drinks beer outside a closed plant and still the UAW contract entiles them to $94.00 per hour . GM and ford though that American consumers will protect them from Honda and Toyota which had much cheaper workes ( on flexible rates ) and made much better cars . The Durbin Grassley amendment will result in the same fate to other american compoanies that happenned to GM and Ford .

AC21 is a law but certain provisions of AC21 have been introduced in separate memos.
Job portability under AC21 is also part of a guidance / memo - so if any AC21 case goes for hearing in an immigration court, any change of employers while 485 is pending is considered illegal. This is not very common though.

We always thought that there is 360k application in BEC and since those LC have PD from 2000 to 2005 there are no chances of fast movement of PD in year 2007 especially for EB3 and EB2(Indian , China).
After reading this news it seems employer withdrew many cases, which they filled for employee who no longer work for company, so certified case is going to be only 100k, much lesser then 360 k. How many more years it will take to clear these 100k LC? I don't think it should take more then 2 years...
But you know logic doesn�t work with US immigration system and we also don�t know how many people are applying through EB1 and EB2-ROW, which are current, we also don't know how many people are already sitting in 485 stage�

I collected my passport with the visa stamped yesterday from the VFS center in chennai. I sent an e-mail on tuesday to the consulate and i got a response from them saying it could take another 4 days approx and the delay was caused by the recent change and the introduction of the PIMS database. It looks like they are digging through your old records as well.
For those people whose passports have been delayed, it's most probably due to the PIMS database and i suggest strongly to send an e-mail with the subject line "PASSPORT PENDING for more than 5 days" and you would most often get the response the next day. Do not call the consulate as they don't tell you what you want to hear. The person who answers the call is an indian and he/she would not have much information to give you.

No, EB3 ROW can use all the available EB3 ROW numbers. But the unused EB2 (ROW/Mex/Phil) have been distributed to the oversubscribed countries.
That's how I interpret that.
The popular belief was that the unused EB2 ROW would first go EB3 ROW but according to this they actually go to the oversubscribed countries in the same category (EB2)
If EB2 quota stays at EB-2 and EB-1 quota goes to EB-2 if unused. That really benefits EB-2 India/China and will hurt all the EB-3 filer. I can see many EB-3 filer, no matter they are China/India/RoW may want to interfile and upgrade to EB-2. I wonder if USCIS do this in purpose to make extra revenue? I have checked with my company's lawyer and he said I can maintain H1 status with my current employer and use EAD for part time job. I read murthy chat transcripts and same topic was discussed with two different answers. I have read at many websites different and I read mixed responses from different lawyers....point is nobody knows for sure if you can maintain your H1 status while working part time on EAD...
In any case, I will be working part time on EAD and I will inform my HR about my status change from H1 to EAD on my I-9 to be on safe side.
I work for a very big company and I have my LC, I140 and EAD approved. I am hoping for the best that my AOS won't be denied. If my AOS application gets denied then I do not think any other company would be able to get it approved. It is true that I will get some time buffer if I am on H1 and my AOS gets denied but I do not want to be limited by work authorization limitations...
Thats my oppinion...

I did paid consultation to find answer to this question with murthy office. As per them, one can do transfer and extension of H1B even after using AP as long as the current I-797 is still valid.
You mean a future employer can transfer and extend my H1 even after I entered on AP, right ?

I had called the congressman from my district (Peter Visclosky) along with the other representatives on the list a few weeks ago. His office had taken my name and address at that time. Today I was surprised to see a letter in mail regarding that conversation and his intention to support the immigration bills in house. So it looks like that the messages we leave with congressional staffers who attend the phones do pass on the message to congressmen.
