I doubt anyone has been through my situation because most of you are high or higher-paid IT professionals. In my case, my company's immigration attorneys have been requesting the prevailing wage over and over for more than a year noiw (in order to get me started with PERM) but the prevailing wage always comes back way higher than what I am getting paid! Evidently, I am severely underpaid, and there is no light at the end of my tunnel unless my company matches the prevailing wage, which I doubt they will do. I used to laugh at those that called H1B the "modern day slavery", but now I am not laughing anymore. Has anyone at all been through this ordeal and can at least share a shoulder to cry on? He hates Illegals and not legal immigrants. I almost have heard him everyday going back home from work and all the time I have heard him saying there are people who legallly coming here for work that he supports. He always has been against "Amnesty" to Illegal Immigrants.

I had my H1 visa appointment on December 27th in Chennai. They said that my visa was approved and that I would recieve my passport within one week. I have not recieved it yet. I called up the Consulate a few times last week and initially they were saying that 'it would take another 2-3 days'. Finally when I called up on Friday the 4th, they said that another 7 days was needed for the PIMS verification.
Still no news......I was supposed to fly out on the 6th to report to work on the 8th but had to postpone my ticket.
Anyone else in the same position please share!

Most of the Congressman offices are now well aware of the issues, phone campaign is not an attempt to explain them the details.
It is more of a push for them to take action by giving them a sense of how frustrated we are. Not many "normal" people would just pick up the phone and call a congressman, right?
While clicking a mouse button takes a fraction of a second, you would have to spend atleast a few minutes picking up your phone, have enough belief in your issue to have the courage to speak to a live person and convey your message.

Just a note( i am not trying to deter anybody or argue against your compilation) that by law all foreigners are required to carry their passport, how many of us follow that, on that note, I will not carry original with me at all. just my 0.02 cents.

But I would think that passports, unlike the PR card, are not designed to be tucked into your wallet for carrying around. Here is what I have understood from my lawyers -
DOL decree, if adopted, will prevent any further labor substitution.
Any labor approved after the decree is adopted cannot be used for substitution.
Any 140 application based on labor sub will not be denied until USCIS adopts a similar resolution - it is unlikely that USCIS will do such a thing as it will lead to lawsuits from lawyers and folks already in the queue
People with already approved 140 do not need to worry at all.
I am laying down the facts here such that people can make educated decisions on what they want to do.

I know there are efforts towards state chapters, but are there any chapters based on big firms where EB2/EB3 seemed to be concentrated? Of course it wouldn't help to put up lnks from the front page as "cisco chapter", "oracle chapter" but at this crucial juncture it would help to encourage 'robust' people from such organizations to go on overdrive even if not web-publicized. just a thought.

I am thankful to everyone who read or responded even if you don't agree. Taking it a step furthur there are couple of things that stand out which i think again show how we twist every fact to our advantage.
1) US need immigration to grow and prosper. wel agreed, but who are we to preach. Its for American to figure it out. We don't care for our mother land i:e India but we are first to point out how US will be worse off if it stops immigration. I really doubt the intention here. You know, we care more bout US then India and once we get our GC we probably wont care much bout US either.
2) Saying its a fight for rights and if we don't fight we are cowards. well i agree we are all cowards not because we are not fighting to bring forward all mighty priority dates but because we showed our backs to our own country. We went to public funded IIT and other institutions and then ran away from our nation at first chance. So yes, in a way we are all cowards here.
3) USCIS should be fair to India. If you look closely, USCIS rules are not country specific. Quota applies to every country, but only India, Mexico and china exhaust theirs. Does tell u something doesn't it.

Can you please provide more details on starting a part-time position and what are some of the complexities associated with it?
While I was waiting for GC, I finished MBA last year. I have a Masters degree in Comp. Sc. also. It has been 4 1/2 years with no clear indication regarding the LC alone. Hats off to the screwed up concept of BEC. If my LC is not processed in time, I might leave next year.
I am thinking of doing a part time job on H-1B also. If that pans out well, atleast I will forget the pain of GC for a while.

Well if we were to carry your reasoning a little bit further ...being a citizen of a country, any country, is only a privilege and not a right as you have to follow the rules and laws of the country.
The actual difference is in the definition as has been pointed out earlier.....
"right" - is something you can ask for because you think it is reasonably fair
"privilege" - is something you are not entitled to or deserve but nevertheless get because someone condescended to give it to you.
By the above definitions what would would classify getting permanent residence as.... the answer lies in the broader way of how we look at life and live it.
Do we always live in fear and cower in front of real and imagined threats - the GC is then a privilege.
Or do we live an honest life - do the best we can - and stand up for what we think is right or wrong irrespective of whether our lives are directly affected or not. The GC then is a right.
Getting a GC in United States is our dream. Following rules and following laws of the system is all what we can do. We can only highlight the defects in the system and ask for a change.
We live a honest life not out of fear of getting caught, but because we believe that that is the right thing to do.
If you are a citizen and stand up for what is right or wrong, then the concerned authorities should seriously look into it.
But if you are not a citizen and stand up for what is right or wrong, then you may be appreciated for that and receive a thank you note. The concerned authorities may or may not pay attention to your concerns. I may be wrong but this is what i feel about it at this time.
Convince me otherwise and i will change my thinking.
In the later case, if you approach authorities in a systematic and professional way and place your concerns like how our immigrationvoice is doing, chances are we will succeed in our efforts.

redesign it to say something to the effect of 'YOU ARE SCREWED MORONS UNLESS YOU DONATE RIGHT NOW!' - making a reasoned argument obviously hasn't worked so far as folks just think someone will do the job for them
