Most people think law suit is a bad thing, but that is not right. In a democratic country law suit is the right way to deal with things. We are legal immigrants, we have all the rights to file a law suit, but with full support of IV.
People have already filed a law suit on the same day the President signed the bill! (yesterday, the wire tapping bill...)
By filing a law suit, all we are trying to do is to fix the laws which are not working. Basically, we are doing the right thing. Not only us, but future Legal immigrants will be benefitted, they don't have to go thru what we had to...
Here are the things that needs to be fixed...
1. Country quota
2. Recapturing visas..
3. 3 year EAD/AP
4. End the endless wait ( Proposing a new law ;))
What is "End the endless wait" ?
EAD is a very good example, If 90 days have passed after filing EAD, you have the option to go to a local USCIS office and get a temp one. We should have a similar option for all the peper work. For example, each and every stage in green card process should have a a day count for processing. Like name check should be completed in 180 days.
Basically, when we receive any receipt notice, it should have a statement which reads "We have received your application and we will take action within 180 days. If we fail to act by MM-DD-YYYY, Please go to the nearest USCIS for approval.."
Sounds little ambitious ?? well, we are not asking for too much, just a day count. Lets say if the whole Green card process takes 3 years or 10 years based on the day count for each stage, people can decide whether they want to immigrate to USA with a clear idea that it will take x days to become a permanent resident ( like how it works in all other countries except USA)
Even a person jailed gets to know how long he is going to spend his time behind bars, but we do not know when we will be free from this immigration mess!

If you are serious about your proposal - please reach out to IV core and ask them provide the necessary guidance to take up this effort.
FYI - it's not easy to propose a bill but Sen. Jeff Sessions (R-Alabama) is your best bet. As much as you can lobby with his legislative office, you'll gain traction on your proposal. Good Luck!

As per one of the patrons on another thread an IO showed him a memo recieved by USCIS suggesting that all Visa numbers for EB2 India/China were exhausted

I have canceled 8/24 appointment and plan on taking appointment during first week of September. Los Angeles USCIS have plenty slot available, so taking it easy in taking appointment.

Hi ruchigup: Could you please update on how your infopass appt went on moday. My attorney said that we could take infopass even now, they(IOs) might keep our case in the queue ready for review for GC in September. But, not quite sure if they (IOs) would really do something abt it in August.

How many days we will have left in Sep month. Now its too late any action we will take may need 15 days or more .. by that time we will have oct month and new bulletin..
rather than there will be a some movement on HR 5882 bill next week.. lets focus on it so it will solve problem for all.
This is also for all and it is not about recapturing the visas alone. It is about justice to anybody whose PD is current. What kind of justice would it be if your PD is current after the visas have been recaptured and you are waiting for 10 years just because your case is not being picked up in the random lottery ?

This is an very very good forum that has helped to answer many of my questions, or clear myths if I might say so... Thanks to everyone who have been posting.
I had one question which I hope someone could help me with. I have a full-time job offer in a very reputed company and am in the same boat as many before me with graduation towards May end (cannot get a degree completion letter before that) and no hopes of the quota for 2009 (Master's) lasting till then. My employer can also apply for the H1 based on my undergrad because my job profile is such. I wanted to know what are the pros and cons (specifically cons) of doing so for the future legal paper-work. I know for one that I might get into the lottery scenario if the similar situation like last year happens. However, I cannot avoid that. I specifically wanted to know what could happen if I do have to change jobs in the next 3 years (and the new employer has specifically hired me based on my Master's degree). In addition, if I have the company start my GC paperwork after 1 year and I need to renew my H1 after 3 years based on my Master's degree, would I need to restart the GC process?
Any other disadvantages of applying for the undergrad quota (for a Master's student) would be welcome.

Everyone in this forum knows that I am a complete moron: I did not even know ROW and Schedule A. So it does not make sense in paying attention to my advice. I still have the audacity to request everyone to pay more attention to the following.
No use fighting. Only the law makers can resolve this issue and they will not listen to us and pursue their own political interests.
Are we fighting over an unexistent pie? There is not even a small pie for us while we are discussing how to divide it.
Both sides have very valid points. It is perfectly fair game for everyone to present the best option for them; since I am moron I don't even know my best option. A healthy debate on the topic is insightfull specially to morons like me. Please convince me how this fight or a similar fight (vs a healthy debate) will lead us to our goal.
It is sad to see contributing members fighting over an issue that we may NOT have to resolve. I wish members contributed (financially) equally vigorously and helped equally vigorously in generating contributions from other members, because contributions will serve some purpose.

In the case of admin fix, we need to focus on those few who can positively act on our request. In this case, those might be Hillary Clinton, Janet Napolitano, USCIS acting director etc. In the case of an admin fix a highly talented, politically skilled, IV delegation should work as the front end of this effort. While all others in the community should raise funds to support this delegation and their activities. We can form regional groups to raise funds on behalf of IV. Many of you can do that. Form groups of 5 at each region and try to arrange an Indian/Chinese movie show in your local theatre for raising funds. You can come up with better ideas than this for raising funds. This is just an idea came to my mind from my limited knowledge.

I would also suggest, not sending any mails yet to Ombudsman till we form a plan of action.

This thread starts with a call to all the EB2 people. Is it only the EB2 people suffering due to USCIS actions? Or are EB2 applicants a distinguised lot that they dont want EB3 to join with them?
It is so depressing to see the attitude of some of these guys !!! There have been so many threads explaining the difference(or indifference) between the qualifications of the applicants.
The suffering has been equally bad or even much worse for the EB3 applicants. I am an EB3 2003 applicant and my suffering has been equally painful. The campaign should be about fair treatment to every applicant, not alone EB2 or EB3.
Any campaign will only be successful when we try to do something together.
If you yourself are belittling the EB3 applicants, why do you have higher expectations from the American Citizens/Government.

We are trying to address a specific issue, which is about blocking approvals when dates are current, and for that, we are using this current fiasco as an example. The USCIS memo specifically talks about EB2 india, china applicants on hold. Since EB3 was listed as U, we cannot do anything about it. If both EB2 and EB3 were current, I would have given a call to both. There is no belittling out here. the Circumstances are like that.

This is a separate issue, but will be useful when visa re-capture is successful.
