    Great Idea. We can have a poll on this just to see how many support this.

    ya, lets step-up a poll and have everyone vote, as if this is the US congress. And after voting leave it for someone else to work on this and other "brilliant" idea. There needs to be a reality check. This poll doesn't mean anything unless there are enough people to spend time and energy at every level. But ya, lets setup a poll and have everyone vote, it will give everyone a feel good factor that everyone contributed in the advocacy effort, how? by voting in the pool and not doing anything about how everyone votes.

    at some point the visa numbers are going to be all used up. The lucky ones would get their GC by then and the others will have to wait for a few months.

    Why worry over it? The line only gets shorter and shorter and everybody will get their turn sooner than later.

    As long as they don't waste any visa numbers, there is no need for any worry. Even their random processing order does not bother me that much, because demand for EB2 will be less than supply next year. Its time for EB3 to fasten the seat belts....

Nothing new, we have seen this story repeat countless times.

    I completed my MS in Computer Science from US around 6 years back, was on OPT for a year & thereafter moved out of US & came back to my home town. Have been working here for 6 years now in the software field & have now applied for H1B under masters Quota. Was wondering if I am eligible to apply under this quota as I am neither a fresh masters graduate nor have any status in the US. Also, my lawyer has only filled out the I-129 form. Is there any special form that needs to be filled out to be considered for Master's quota?

    Recently all of us in the IV community were thinking and worrying about what the future holds for skilled immigrants in this country. Day by day things are getting tougher! All of us in IV community (including the leadership) have different ideas about how to approach the problem. Under the IV leadership, we have a set of declared priorities and our lobbyists and community are working for those. Even when we work for those stated goals and priorities, we have to reevaluate what is feasible in the changing environment.

    In this increased protectionist environment, Re-Capture, Country Cap Elimination and Immigrant Visa increase seems difficult if not impossible. So, I would like to propose a SMALL STEP, which would provide us HUGE BENEFITS and at the same time satisfy all stakeholders (including anti-immigrant community) as this is the least controversial method.

    Some of us may say that this won�t work. Some of us support a big-bang theory. Some others argue for the already stated goals and priorities from the IV leadership team. I agree with all these groups of our brethren, but at the same time, I urge each and every member of our community to give a serious consideration of this proposal before shooting it down.

    Please do not use this thread to point fingers at one another. Always remember, when you point fingers at someone, three of your fingers are pointing towards you and one stays neutral. Please try to avoid statements like the following in your reply to this post to encourage serious and productive discussion:

    �Why didn�t you update your profile with all information?�
    �What have you done so far for the community?�
    �Did you participate in these so and so initiatives of IV?�
    �You are a line cutter who used substitution�
    Etc etc etc�the list goes on.

    We have far more things that unite all of us than the few things that divide us. So, let us focus only those things that unite all of us. If we are united, we can easily solve all our differences. As AR Rahman said, always we have the option of choosing love over hate.


    PROPOSAL

    Our main concern with respect to GC journey is the UNCERTAINITY! I am sure all of us worried at least one time �What happens if my 485 gets denied after all these years of waiting?� Many of us here are expecting a GC wait time of 2-12 years. So, a denial at the end would be little bit disheartening.

    The normal processing time of a 485 application ranges from 4 months to 12 months. For all the retrogressed countries, this would be 2-12 years. All of us, who are in the Adjustment of Status category, are legally allowed to stay and work here in the US. So, in no way we are additional burden to the country. So, all the shackles on the GC applicant and family during the years of retrogression period are not beneficial to anyone in this country and it is not protecting anyone�s job. These shackles just inflict pain to the GC applicant and family � that's all - nobody is benefitting from this!

    So, if we can work to obtain Adjudication of all I-485s irrespective of whether the country is retrogressed or not � we have a solution. As per the INS rules, an immigrant VISA cannot be allocated outside the numerical limit. If the country is not under retrogression, the applicant will get his GC. If the applicant�s country is a retrogressed one, instead of obtaining the Green Card, I-485 processing-status could be changed to a new one such as �Adjudicated � Pending Visa Allocation� (meaning: Adjudication completed, Visa allocation pending). So, in essence, when the VISA numbers are available, then only the person will get Green Card. But at the same time, the applicant and family can feel the relief � No need to worry about RFE, NOID, MTR etc, because the 485 is already approved and it is in a Pending Visa Allocation status. So, in the case of all these retrogressed countries, the actual allocation of Green Card may take 2-12 years time depending on the availability. This option will go well with the protectionists.

    If the status of the 485 application is �Adjudicated � Pending Visa Allocation� and the applicant�s country is a retrogressed one, S/he should be eligible to obtain 3, 4 or 5 year EADs with travel benefits associated. Also, the applicant should be able to take any job after 1 year of the status change date of the status �Adjudicated � Pending Visa Allocation�.

    I believe the above proposal is a small step in the eyes of the protectionists where as it is a big leap for all retrogressed country applicants. We may be able to achieve this using administrative fix or an action from the Executing branch, as this won�t change the annual GC quota of 140000. Apart from this, this will encourage all those skilled immigrants to invest in American economy within 1-2 years of filing AOS application. At present most of us are sending our money to our home countries as our situation is so uncertain. This effort will definitely help the ailing economy and will serve as a boost to the housing market.


    Whom should we approach to get this done?

    Ans: Hillary � Yes Hillary Clinton. She is the number 1 friend of people from China and India, who is in the current administration. Her department is also in charge of the 140K Visa numbers, Travel related visas etc. If we can get support from Compete America, prominent members of Indian and Chinese communities in US, Ambassadors of China and India to US and approach Hillary, we will be successful. Hillary may be very much pleased to start an initiative to achieve this, as she has a chance to influence 700K+ Indians and Chinese immigrants in US, in a very positive way. At the same time, politically this won�t create much problem � Status quo will remain the same � even after such an administrative fix. There is no net addition of immigrants to this country.

    With Hillary�s support, if we approach Janet Napolitano, we may have a solution.

    So, once we obtain this admin fix (first step), then we will work to obtain the Allocation of GC issue for all those folks who are waiting to get the GC allocated.

    Every progress starts from a dream. So, if someone would like to call this a dream, please feel free to!

    So all of you who support this, please think in terms of how you can convert your verbal support into action in some way, in the coming days.

    Regarding a HIGH VISIBILITY Campaign

    My opinion: Personally, I am against high visibility campaign for an admin fix. We do not need too much visibilty for an admin fix unlike a legislative fix. In the case of admin fix, we need to focus on those few who can positively act on our request. In this case, those might be Hillary Clinton, Janet Napolitano, USCIS acting director etc. In the case of an admin fix a highly talented, politically skilled, IV delegation should work as the front end of this effort. While all others in the community should raise funds to support this delegation and their activities. We can form regional groups to raise funds on behalf of IV. Many of you can do that. Form groups of 5 at each region and try to arrange an Indian/Chinese movie show in your local theatre for raising funds. You can come up with better ideas than this for raising funds. This is just an idea came to my mind from my limited knowledge.

    EB3 Guys,

    Take it easy... This is just for humour, to have fun at these times.

    No green card for you. Just work well for 6 years, enjoy life in US, enjoy sports cars by renting, not by buying, rent a big house, have a lawn and garden in back yard, grow your own vegetables. Have nice vacations like Hawaii, Jamaican islands, Vegas, Porto Rico etc.,Have fun in life. Do not go for green card. After 6 years, get nice job in India,own apartment near to office and ask your parents to live with you. Take kids to school . Have fun with them. Try to become director, AVP,VP,SVP,CEO,CTO and President. Do not go for green card. After you become director, buy a single family home and mercedez or BMW and have fun. Retire by the time your kids become earners. Grow vegetables in back yard. Do gardening and have fun. Thats how life should be. Do not hope for green card. H A V E F U N.

    This is just about the single most sensible post ever on this site. This holds good for everyone, not just EB3. Having fun is a choice and can be excercised in all circumstances. Thank you for the reminder.

    I think he is telling the truth. Otherwise we would have almost 100% attendance for the rally. But it does not seem like. So, i think we "so called higly educated and qualified" need to think about it.

    Maybe so. He like many other people (esp. on TV) has a hidden agenda in his message. Why does he want you to contact him thru email? I for one stay away or get swayed by anyone on this board esp. if it their second post. All I can say is good marketing, sorry but tough luck.

    I am not on estrogen therapy, but I decided to write about the feelings that I underwent during the 3 days of the event. If you do not want to read the entire post, skip to the last paragraph.

    1. Anxiety: On Sunday, as I was making my way towards Hyatt Regency on the Capitol Hill (a beautiful and an expensive hotel) I was a little anxious about meeting new people (I am a closet introvert :D ). I was not sure if the people would just continue the non-productive conversations about Eb3 vs EB2 or India vs ROW or just be plain annoying. Boy, was I wrong!!! That anxiety disappeared in a matter of minutes after walking in the situation room. The folks were dedicated and meant business. The leadership of the core group was evident, they made sure that we didn't go off message, relatively an easy task for them since most of us there realized the importance of keeping on message.

    2.Excitement: As we started the training, people started pouring great ideas (and few not so great IMHO).The trainer in chief chased each of these ideas to its logical conclusion and without saying whether they had merit or not made it obvious for us to decide. How classy and what a phenomenal coaching style!. The talking points that we discussed were articulated meticulously and question/comments were dealt with insight, experience and facts (this one is very important, we all know what opinions are like...). This was the one feeling (excitement) that lasted through the 3 days and I still cant shake it off (not that I am trying, but I don't want people to confuse me for the energizer bunny!! - we have some one else for that ;))

    3.Nervousness: The first meeting. No, no not with the folks from Congress, but the mock meeting at the training session. The veterans gave us a demonstration of their insights/ knowledge and quick wit. So of course I was nervous coming in after that performance. I volunteered to be on the first ones of these mock sessions and felt all eyes in the room on me. I tried to focus on the task at hand (which was at that time, to stop my legs from shaking ;)). Perhaps, the mock session was the toughest of all the meetings that I had on the hill (remember that the hotel was 'on the hill' too :)).

    4.Awesomeness: This is what it was all about. For me as a first timer, entering the hallowed halls of congress and participating in the democratic process up close and personal is an awesome feeling. Just walking down those corridors and noticing the closed doors with signs that say 'Appropriations Committee', or 'Democratic Caucus' and knowing that laws that affect lives of more than 300 million people are being crafted, debated and being voted on right there....what a rush. I think this too will be with me for a long long time.

    5.Camaraderie: This is a fun bunch of serious people on a mission. I think mostly everyone hit off well with everyone else. I made a whole bunch of acquaintances that I feel could mature into strong friendships. Even though we worked our collective butts off, there was always light hearted humor floating around. It was great.

    6.Gratitude: Looking at the hard work put in by the countless tireless volunteers was a humbling experience. These very kind souls put in hour after hour of work during the event but they put in even more before the event started. I don't know, if the rest of you know, organizing an event at such a scale is a massive undertaking and despite hiccups we came out the other end in great shape. My gratitude goes to all the people that put their hearts, minds and souls in allowing our community to participate in the democratic process at the highest level. Thanks for making this happen.

    Why am I writing this you wonder (or may be not). This event changed me. I felt myself grow in these 3 days. I rubbed shoulders with some of the most famous and powerful men and women in the nation and conveyed our message. I also saw first hand the resource constraints that IV has and how they figure something out and make it happen. Trust me folks, it is not easy to work thanklessly for days on end for 18 hours and still keep a cheerful demeanor but they did. My sincere thanks to IV leadership, all the fellow volunteers and all monetary contributers for allowing me such a great opportunity. Part of me hopes that we never have to do this again, but that hope also makes me sad that I probably wont get to experience a full gamut of feelings again.
    Thanks to all IV efforts. It was indeed a great experience to meet all great IV people from all states and to know them more and learn more about everything.

    Countries have borders and laws for a reason, and each country has the right to protect its borders and uphold the laws. Most of us being of Indian descent, should look into our own house. What is happening to Biharis in Maharashtra...are Biharis not Citizens of India.....we don;t even tolerate people of other states, coming to our state!! and expect US to just keep letting trespassers in?


    The name of this Country is "UNITED STATES of AMERICA"...NOT "FREE_FOR_ALL REFUGEE CAMP"..

What I was saying is that if we take the majority of the posters who have responded / posted in this thread, we are seeing an overwhelming majoiry who support and /or sympathize with the pregnant girl. We are definitely not going to change our opinions and so are you. so let us stop this argument with a clear awareness that the majority of the posters are siding with the girl regarding the inhumane treatment delivered to her.     On a positive note, the best that we can do is, learn from our surroundings. We can learn a lot from Republicans to understand what not to do.

    One of the main reason why Obama enjoys high rating - Republican party sucks. Who is making Republican party look bad - Republicans. The best response to Obama is not to pitch twisted Jindal against Obama, because that just makes Obama look good and it help Democrats. The better response to Obama is, let Obama respond against Obama. So simply don't respond to Obama, which will prevent Republicans making him look good. And like every politician, Obama will commit mistakes, which will cause the demise of Democrats. Its that simple. So what do we learn from this?
